Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of ZoneIQ (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What ZoneIQ is

ZoneIQ is a software tool that aggregates parcel, zoning, hazard, and legal data and applies a deterministic engine to estimate what may be buildable on a California property and to prepare draft documents. It is a research and decision-support tool.

3. Not professional advice; no warranty of accuracy

ZoneIQ provides information, not professional advice. ZoneIQ is not a law firm, architecture firm, engineering firm, or land-surveying firm, and nothing it produces is legal, architectural, engineering, surveying, appraisal, or investment advice. Outputs are decision-grade screening and draft preparation only.

Zoning law, building codes, and incentive programs change frequently and are subject to interpretation by the local agency with jurisdiction. Source data may be incomplete, out of date, or in error. You must independently verify every result with the applicable city or county and with licensed professionals before relying on it, spending money, or submitting anything to a government agency. Items the Service marks “NOT EVALUATED,” “requires verification,” or similar must be confirmed by a qualified professional. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

4. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate information and be at least 18 years old.

5. Subscriptions and billing

Paid plans are billed through Stripe on a recurring basis until canceled. You can cancel at any time; access continues through the end of the current billing period. Except where required by law, payments are non-refundable. We may change pricing on prospective notice.

6. Acceptable use

You agree not to misuse the Service, including by scraping at scale, reselling outputs as a competing data product, attempting to breach security, or using the Service unlawfully.

7. Limitation of liability

To the maximum extent permitted by law, ZoneIQ and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost property value, denied or delayed permits, or decisions made in reliance on the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

8. Indemnification

You agree to indemnify and hold harmless ZoneIQ and its operators from claims arising out of your use of the Service or your reliance on its outputs.

9. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
